No, if you are viewing a video on YouTube and the embed code is available then you can embed it on your site. YouTube gives users the ability to turn off embedding for particular videos. So if a user did not want anyone to embed a particular video, they could restrict the embedding for that. See: Restrict embedding

I did not needed to upload a video, because we have a parameter in youtube api. I integrate it into the script and we do not take videos, which does not allow embeding
